Gutrace — Terms and Conditions
These Terms and Conditions (“Terms”) govern your use of the Gutrace mobile application and related services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Health disclaimer (important): Gutrace provides informational guidance only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified clinician for medical questions, and do not use the Service for emergencies.
1. About Gutrace
Gutrace helps users interpret food labels and menus by highlighting potential dietary triggers and providing a “Safety Score” and recommendations (for example, “Safe / Caution / Avoid”) based on the information provided and your settings. The Service may also offer optional tracking tools to log meals and symptoms over time.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under the age of majority where you live, you may use the Service only with consent of a parent or legal guardian.
3. No Account / Device ID
The Service may be available without creating an account. To operate the Service and help manage purchases and settings, we may associate certain Service data with a device identifier (for example, a device ID provided by your operating system). See our Privacy Policy for details on what we collect and how we use it.
Important: Because some Service data may be tied to your device and/or app store account, uninstalling the app, resetting your device, or changing devices may affect your ability to access remaining subscription benefits or settings. Where available, you can use your app store’s “restore purchases” feature.
4. License and Acceptable Use
4.1 License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service for your personal, non-commercial use.
4.2 Acceptable Use
You agree not to:
- Use the Service in a way that violates any applicable law or infringes any rights of others;
- Use the Service to make decisions in a medical emergency (call your local emergency number instead);
- Attempt to reverse engineer, decompile, or bypass security or usage limits of the Service;
- Use automated scripts to abuse scans, features, or infrastructure;
- Interfere with or disrupt the Service (including by introducing malware);
- Use the Service to provide professional services to others (e.g., medical or clinical advice) without authorization.
5. Your Inputs and Logs
The Service may allow you to provide information such as food names, ingredient lists, menu descriptions, dietary preferences, symptom notes, and other health-related context (“User Inputs”).
You are responsible for your User Inputs, including ensuring they are accurate to the best of your knowledge and that you have the right to provide them. You should not include information you do not want processed to provide the Service.
6. Ingredient Analysis, Safety Scores, and Personalization
The Service provides outputs such as ingredient flags, risk alerts, and Safety Scores based on the information provided, general dietary heuristics, and (if enabled) your preferences, history, and tolerance settings. Outputs may be generated using automated systems and may not be accurate, complete, or appropriate for your situation.
You understand and agree that:
- Food suitability and trigger responses vary widely between individuals and can change over time;
- Menus and labels may be incomplete, inaccurate, or outdated;
- Preparation methods, portion size, cross-contact, and additives may change a food’s effect and may not be knowable to the Service;
- The Service cannot confirm whether a food is pathogen-free, allergen-free, or safe in all circumstances.
7. Subscriptions and Purchases
Some features may require a subscription or in-app purchase (for example, unlimited scans or advanced tracking). Subscriptions and purchases are processed by your app store (such as Apple App Store or Google Play). Prices, renewal terms, and cancellation methods are controlled by that app store and displayed at checkout.
7.1 Renewals and Cancellation
Your subscription may automatically renew unless you cancel it through your app store settings before the renewal date.
7.2 Refunds
Refund requests are handled according to the policies of the app store where you made the purchase. We do not control app store refund decisions.
8. Third-Party Services and App Stores
The Service may rely on third-party infrastructure (for example, cloud hosting, analytics, or ingredient interpretation services). Your use of third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party services outside our control.
9. Health & Food Safety Disclaimers
9.1 Not medical advice
Gutrace is provided for informational purposes only and does not provide medical advice. The Service is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions you may have regarding a medical condition, symptoms, diet, or treatment plan.
9.2 Not for emergencies
Do not use the Service for medical emergencies. If you think you may have a medical emergency, call your local emergency number immediately.
9.3 Food preparation, cross-contact, allergies
The Service cannot verify how food is prepared or handled. Even if ingredients appear “safe,” foods may contain allergens, be cross-contaminated, or include hidden ingredients or substitutions. If you have food allergies or a condition requiring strict avoidance, you should confirm ingredients directly with the manufacturer or restaurant and follow your clinician’s guidance.
9.4 No guarantees
We do not guarantee that any recommendation, alert, or Safety Score is accurate or that eating any food will be safe for you. You assume all risk arising from your food choices and reliance on the Service.
10. General Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. Outputs and results may vary based on input quality, device, settings, and other factors.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY RELIANCE ON A SAFETY SCORE, RECOMMENDATION, OR ALERT; (C) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SYSTEMS; OR (D) ANY THIRD-PARTY SERVICES USED WITH THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnity
You agree to indemnify and hold us harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your User Inputs, your misuse of the Service, or violation of these Terms.
13. Changes to the Service or Terms
We may update the Service and these Terms from time to time. If we make material changes, we will post an updated version in the app or on our website and update the “Last Updated” date above. Your continued use of the Service after the update means you accept the revised Terms.
